Introduction

The individual with Disabilities Education Act (IDEA), sometimes referred to as “ The Bill of Rights “ for Children with exceptionalities is a United States Federal law that regulates the various programs related to special education, early intervention and related services in respect to children with disabilities by the various agencies of public and states. It deals with the educational needs of children with disabilities with disabilities from birth to age 18 or 21 coming under 14 specific categories of disability. It is introduced in the Senate by Senator Tom Harkin (D-IA) on October 31, 1989, passed the Senate on November 16, 1989 and house on June 18, 1989. Later on October 30, 1990 it is signed by the president George H.W. Bush. In defining the special purpose of special education, IDEA 2004 expresses intention of providing a child with a disability a Free Appropriate Public Education (FAPE) and enables them for further education and employment. IDEA is mainly derived from Education for All Handicapped Children Act, it has been reauthorized and amended for number of times and in most recent in 2004 (Flanagan, R. (1995)). Under IDEA 2004 defines special educations and related services in order to fulfill the requirements of disable eligible children to prepare them for education, independent living and employment in future. IDEA does not require parent to consent to a referral, however for an evaluation to take place there must be parental consent.
