1. Who is responsible for establishing OSHA standards?

There are two agencies which are exclusively responsible for the creation of these standards on a larger basis, the two agencies being occupational Safety and Health Administration (OSHA) and National Institute for Occupational Safety and Health (NIOSH).

These agencies are permitted to set standards for all private sector employees but it is not mandatory for the public sector employees.

2.  If an employer is unable to comply with an OSHA standard,   what alternative is available to the employer?

Even though OSHA was created to make sure employees are kept safe, they are also known to be very helpful, approachable and flexible in its approach as well as execution. If an employer is unable to meet the OSHA standards, that employer is able to meet with the appropriate agency within the employer’s jurisdiction for some help within the area that the employer is having problems.

3. Steven Goldberg, who is Jewish, is a factory worker at Uranus Umbrella Company. His work shift has been changed on weekdays to 11:00 a.m. to 7:00 p.m. He asks for an accommodation to have his shift adjusted on Fridays to allow him to return home before sunset. Uranus claims this accommodation would place it in violation of the seniority provision of the collective bargaining agreement it has with Steven’s union.

Question: How would you advise Uranus?

I would advised Steven to approach his Union leader and his issue with the time that was establish as part of a collective bargaining agreement. Due the type of accommodation that Steven is asking for it will be in direct violation of the collective bargaining agreement.
