The video, “Product Liability,” depicted a business situation in which Quick Takes Video entered into a lease agreement with Non-Linear Pro, a company that sells and leases video editing equipment and software. Quick Takes Video’s intent for acquiring the new editing equipment from Non-Linear Pro sought to increase the editing capabilities and efficiency of their current editing system. Based on the product description and sales pitch provided by Non-Linear Pro, their editing system would reduce the total time spent on each product by half, and all jobs would be completed twice as fast. Furthermore, upon completion of installation and training on the use of the new system, Non-Linear Pro ensured Quick Takes Video resumption of full operational status in a day to a day and a half. The employees of Quick Takes Video completed the necessary training and after two weeks, they determined Non-Linear Pro’s editing system ineffective, inefficient, and the cause of countless lost man hours. In addition, Janet, an employee of Quick Takes Video, injured herself while handling the drive of the editing system. These combined factors identify some tort risks that warrant resolution and if properly evaluated and mitigated using Enterprise Risk Management (ERM) could serve as a lesson to companies, preventing, or avoiding future violations.

When the software arrived, the employees of Quick Time Video completed their training with a trainer, watched the video tutorial, and read the manual that came with the software. Once training was complete, the employees quickly began using the editing software. They soon noticed that the software was not working as promised.
