The “Product Liability” video presented the Non-Linear Pro video editing system, the manufacturer of this software editing product failed to apply the tools of Enterprise Risk Management (ERM), and they exposed themselves to liability through defect in manufacture. The product did not meet its specifications, and it did not function as stated by the sales representative of the company (misrepresentation). Because of this, defect in manufacture tort liability is applicable. After all, defect in manufacture (Cheeseman, 2010) “occurs when the manufacturer fails to (1) properly assemble a product, (2) properly test a product, or (3) adequately check the quality of a product.” Further strict product liability issues were raised when a user of the product was injured by a piece of metal or bur in the packaging of the products’ drive, even though the injured person was trying to unpack the drive with not enough lighting; this situation demonstrate the breached of the duty of care from the Non-Linear Pro Video editing system manufacturer. Even though the video does not offer information in which condition the items were received or how they were assembled, it is obvious that the injury received by one of the user/customer was for improper packaging and the neglect of proper warnings.

For the Non-Linear Pro video editing system the exposed metal , the presence of flaws and errors in the software and failure to perform because of insufficient memory, proves defect in manufacture. The manufacturer’s claims that the Non-Linear Pro trainer would from Non-Linear Pro be up and running in a day and a half, and it would be twice as fast with the Non-Linear Pro video system was not the result obtained by experience, the preceding facts can be an act of misrepresentation. The customer’s employees receive one day training. Despite reading the manual and watching the manufacturer video on top of this training, the employees are still having difficulty with the equipment....
