Elements of a contract paper

The term contract entails the acceptance of one party's offer by another party. Apparently, a valid contract involves elements such as acceptance and offer, intention to create legal relations, legal capacity, consideration, and consent. In the case study, though there is a contact that takes place between Jack and the older adult widow, the contact does not abide by certain elements. Bearing in mind the older adult widow's daughter wants the contract to be reversed, the shortcomings of the contract are likely to favor her pursuit.

Jack should not engage an attorney in a bid to defend himself against the accusations of the widow's daughter. The fact that the elements of the contract are clearly stipulated in the law and that Jack went against the law will have the court rule in favor of the widow's daughter. The daughter claims that her mother was experiencing symptoms of Alzheimer's disease, and this might have interfered with her mental capacity. Essentially, the legal position of the contact between Jack and the older widow is questionable because Jack hastened to enter into a contact with a person with a mental impairment. Therefore, Jack's decision of engaging an attorney would not be of significance in the case.

It is worth noting that there was a valid contract when Jack purchased the China for $150.00. This is attributed to the fact that the element of offer and acceptance was followed to the latter. Jack made an offer of 150 dollars for the widow's entire lot of China. The validity of the contract is seen when the old adult willingly accepted Jack's offer. However, Jack was surprised to hear that the entire lot of the China cost $150.00 yet a single plate of the lot would be sold at a similar price in New York. With the superior knowledge, he hurriedly purchased the entire lot, without getting into a legal binding with the old adult widow. It is true...
