Individuals, each and every day are subject to laws determined by the government. It is rare for many individuals to justify the functions and roles of law in business or life in general. Law is described as, "a body of rules of action or conduct prescribed by controlling authourity, and having legal binding force” (Melvin, 2011, p. 721).

Functions and Role of Law in Business and Society

The law within society exists to ensure order is maintained in every person’s daily work and home life. Law is regulated to establish the standard of what actions are lawful and appropriate or inapropriate and unacceptable. If someone breaks the law, retribution is determined according to the offense conveyed. To make sure that laws are followed, they must be equal across the board that is consistent and unchanged. If one does not follow the laws and punishment is equal and consistent, the two will be balanced in accordance with the proper laws. This law is equally important in the economy, society, and business. If laws were not in place, social order could not be maintained. If laws are in place but not upheld, anarchy would ensue and social order would break down. Laws by design protect the population and give freedoms to the population and remove rights from the individual.

There are many types of law and roles of those laws in business and indiviual climate settings. A prime example of such laws is the Cipollone v. Liggett Group, Inc.et al. In this case, Cipollone filed a lawsuit against a cigarette manufacturer for "false advertising, fraudulently misrepresenting the hazards of smoking, and conspiracy to deprive the public of medical and scientific information about smoking" (Melvin, 2011, p. 33). Cipollone had the legal right to file lawsuit via a substantive law. The regulations, legislative codes, and laws allowed him to sue via procedural law.
