INTRODUCTION

Douglas v. Independent Living Center of Southern California , Douglas v. California Pharmacists Association and Douglas v. Santa Rosa Memorial Hospital are three cases ( “The Douglas case”) that raise the same issue, whether Medicaid beneficiaries and providers can challenge a state law in federal court on the basis that it violates the federal Medicaid Status that reduced payments to providers. Now In days there are a lot of low-income and other susceptible populations in the United States which there primary source of health insurance is Medicaid. Medicaid is governed by the federal Medicaid Act, which sets out the basic legal framework that states elect to participate and must follow when administering their programs. When state actions appear to violate the federal law, Medicaid beneficiaries or providers have brought suit seeking to enforce specific Provisions of the Medicaid Act , which itself do not speak to the role of the federal courts. Federal courts have taken a closer look at the legal criteria those beneficiaries and providers must establish before being permitted to pursue these cases. The United States Supreme Court was asked to decide the preliminary issue of whether the Supremacy Clause granted the plaintiff’s a right to sue.

I. THE CASE

The Medicaid program approve the allocation of federal funds to participating states to pay back the health care providers for services provided to individuals who are eligible for Medicaid . If a state wants to receive this federal funding the requirements in the Medicaid Act must be complied . Medicaid plans should reimburse health care providers in order to receive the federal funding at the rates that are sufficient to provide quality medical care or any type of motivation to providers to join the plan .
