Good morning, everyone. Today, we group G is going to introduce one type of ADR, the collaborative law to you.

Our presentation is divided into four parts: First one, a brief introduction on collaborative law. Then, how does collaborative law works? After that , we will focus on the advantages of collaborative law. At last, we have 2 cases for you to have a better understanding.

What is collaborative law?

It is a legal process to enable couples who have decided to separate or end their marriage to work with their lawyers and other family professionals,

It is also called collaborative practice, divorce law, or family law.

There is some information on its history.

Ever since its inception in the 1980s, the Collaborative Law movement has spread rapidly to most of the United States, Europe, Canada and Australia. More than 22,000 lawyers have been trained in Collaborative Law worldwide and more than 1,250 lawyers have completed their training in England and Wales where Collaborative Law was launched in 2003.

The growth of the collaborative process in England and Wales has been encouraged by both the judiciary and the family lawyers organization, Resolution.

The two main functions of collaborative law areā€¦

First one, to avoid the uncertain outcome of court and to achieve a settlement that best meets the specific needs of both parties and their children.

Second one, to facilitate a broad range of other family issues, including disputes between parents and the drawing up of pre and post-marital contracts.

Here comes the second part: how does it work?

We will focus on 3 main points.

First, relevant organizations. As shown on the ppt, IACP, ABA, AAML, IAML are four organizations related to collaborative law. Among them, IACP, the International Academy of Collaborative Professionals, is a primary global collaborative organization founded in the late 1990s.
