Abstract:

Sexual orientation is a disputable subject especially when it comes to same-sex marriage. The disputes included factors like religious beliefs and social values. The long-existing situation as the second class has prevented the homosexuals from equal rights. While the debates are mostly concerned with the marriage and equality, how the courts resolve the apparent tension or conflict between the protection provided by sexual orientation and the religion or belief provisions is discussed. Will themselves be inconsistent with the principles of equality in relation to sexual orientation. The paper examines the specific case Hollingsworth v. Perry from the perspective of rhetoric and argument to show how opponents and proponents of Proposition 8 use existing information to defend their own position and rebut the arguments of the other side. This paper reviews the debate based on the scripts of closing arguments enclosed by U.S. Supreme Court on June 16th, 2010. The example illustrates the wide variety of related issues to be taken into consideration in the decision of trial. By establishing the argument of both sides and specifically classified the argument used into 4 categories especially argumentation schemes as a tool of analysis, I tried to explore the tactics, used in the trial and the utilities of the arguments.
