EMC Confronts Harassment

1. It seems that EMC has violated a few different laws. They violated the Equal Pay Act. It seems that men sales reps with the same amount of service time as women were being paid more for the same job skills. Another law they broke was the Civil Rights Act. They were discriminative to the women sales reps by taking accounts from them and giving them to male colleagues. Lastly was VII of the CRA and retaliation. Female employees were subjected to demeaning sexual comments, company paid trips to strip clubs and retaliation for complaining.

2. EMC won’t be able to continue aggressively selling and avoid sexual harassment and discrimination, unless they make some changes. If they continue to subject female employees to strip clubs and sexual harassment verbally they will end up losing their credibility and possibly lots of money with the many lawsuits they will continue to face. In order for them to resolve this they will need to officially apologize to the women employees that were offended. They will then need to change their practices by making sure they pay women the same when their skills are the same as male colleagues, train employees on the importance of not committing sexual harassment and implementing disciplinary actions when these policies are broken. As well they will need to require everyone to go through work ethic training and terminate the employees that violated all the laws to set an example for the company’s future.

3. One action I would recommend would be assigning a special group in the HR department where complaints would be reported. Upon receiving a complaint they would be required to investigate the incident within 48 hours. Upon the conclusion of their investigation if any violations have been found the employee/employees should be disciplined up to and including termination. Another action I would take is...
